Frequently asked questions

Does my website or app need terms and conditions?

Not legally required in most jurisdictions, but strongly recommended if you: allow user accounts; sell products or services; host user-generated content; or offer any service. Without T&Cs you cannot limit liability, enforce acceptable use rules, or resolve disputes clearly.

What should website terms and conditions include?

Acceptance method; service description; user accounts and security; acceptable use (prohibited activities); IP ownership; user-generated content licence; payment and refunds; limitation of liability; indemnification; account termination; governing law and jurisdiction; and how you notify users of term changes.

Can I copy terms and conditions from another website?

No — T&Cs are copyright material. Copying is infringement and the copied terms may not apply to your business model, jurisdiction or user base. Generic T&Cs not tailored to your service may be unenforceable when you need them. Use a generator as a starting point and tailor the output to your specific situation.

What is a limitation of liability clause in T&Cs?

A LoL clause caps your maximum financial exposure. Common approaches: cap liability at fees paid in the last 12 months; exclude consequential losses (lost profits, lost data); disclaim warranties ("as is" service). Cannot limit liability for death or personal injury caused by negligence (UK/EU law). Consumer-facing T&Cs subject to Consumer Rights Act 2015 (UK) — unfair terms are unenforceable.
